To protect both the Artist and our collectors, this Copyright & Artwork Usage Policy explains the ownership, permitted uses, and restrictions relating to all artworks, images, designs, and creative content available through our website.

1. Ownership of Copyright

We always appreciate being credited when you share our artwork online by tagging Flamboyant Phoenix, although this is not mandatory unless otherwise agreed.

4. What You May Not Do

Without our prior written permission, you may not:

  • Reproduce the artwork.
  • Scan or digitally copy the artwork.
  • Print copies.
  • Create posters.
  • Produce merchandise.
  • Mint NFTs.
  • Sell digital versions.
  • Modify or edit the artwork.
  • Trace the artwork.
  • Remove watermarks.
  • Use the artwork in advertisements.
  • Use the artwork for commercial branding.
  • License the artwork to another party.
  • Incorporate the artwork into books, films, videos, websites, games, software, or AI training datasets.
  • Claim authorship or ownership of the artwork.

Any unauthorized use constitutes copyright infringement and may result in legal action.

5. Commercial Use

Commercial use of any artwork requires our prior written permission. Commercial use includes, but is not limited to:

6. Digital Images

8. Commissioned Artwork

For commissioned artwork:

  • Copyright remains with Flamboyant Phoenix and the artist unless a separate written agreement provides otherwise.
  • The client receives ownership of the original physical artwork.
  • The client may display the artwork privately.
  • Commercial reproduction requires written permission.

Unless requested otherwise by the client, Flamboyant Phoenix reserves the right to display commissioned artwork for portfolio, exhibition, website, educational, and promotional purposes after delivery. If a client prefers that a commissioned artwork remain private, they should notify us in writing before completion of the commission, and we will make reasonable efforts to honour that request.

9. Certificate of Authenticity

Where applicable, original artworks are accompanied by a Certificate of Authenticity. The Certificate confirms the authenticity of the physical artwork but does not transfer copyright or reproduction rights. The Certificate itself is also protected by copyright and may not be reproduced or altered.

10. Artist’s Moral Rights

The Artist retains all moral rights recognised under applicable law, including the right:

  • To be identified as the creator of the artwork.
  • To object to derogatory treatment or distortion of the artwork.
  • To protect the integrity and reputation of the artistic work.

11. Artificial Intelligence (AI)

Unless expressly authorised in writing, no artwork, photographs, sketches, or images from Flamboyant Phoenix may be:

  • Used for AI training.
  • Included in machine learning datasets.
  • Used for image generation systems.
  • Used to create derivative AI-generated artwork.
  • Uploaded to AI image generation platforms for commercial purposes.

12. Educational and Editorial Use

Educational institutions, publishers, journalists, bloggers, and researchers wishing to reproduce our artwork should contact us to obtain written permission where required. Permission may be granted subject to appropriate attribution and licensing conditions.

13. Copyright Infringement
